New York State raised the minimum wage to $6.00 per hour effective January 1, 2005. This exceeds the Federal Minimum Wage, however, the limitation on the amount that can be withheld from a debtor under an income execution has not been affected. The limitation in the New York law (CPLR §5231) is based upon the Federal Minimum Wage.
